History[edit | edit source]

In July 1872 there was a dispute between Michael Cavanagh and his son in law, John Fitzgerald as to who owned the the hotel:

Application.—Mr Salter, on behalf of Mr Michael Cavanagh, applied to the bench to receive from John Fitzgerald, possession of the premises known as the Lady of the Lake hotel, Learmonth. The application was made under the Landlord and Tenants Statute, part v, clause 90. Counsel having proved service, of notice on Fitzgerald, applied for a warrant to be handed to the police for execution. The parties stood respectively in the position of father-in-law and son-in-law. It appeared from an agreement produced and handed to the bench that one year’s lease of the said premises' had been granted to Fitzgerald, which lease had recently expired. Fitzgerald, who was in court, though not summoned, denied tenancy, disputed the title, and said he had never been asked for rent, nor had he paid any. He claimed the property as his own. In reply to the bench, Mr Cavanagh stated that on several occasions he had asked Fitzgerald for payment of rent due; the last application, being made about a fortnight ago. The bench postponed the case for a week.[2]
